Dorothy M. Preston is the wife of Michael D. Preston, an attorney practicing law in Milwaukee, Wisconsin, who is also a defendant but is not appealing. The plaintiff Daniel W. Howard as receiver for Pan American Motel, Inc., brought this foreclosure action, which is an aftermath of Frick v. Howard (1964), 23 Wis. 2d 86, 126 N.W.2d 619. In that case this court stated that Mr. Preston dominated the activities of Pan American Motel, Inc., and had perpetrated a promoters fraud upon the corporation to the extent of $110,000 by a transaction which was not fair and above board. In a suit by the plaintiff against Mr. Preston and his wife to recover funds for the benefit of creditors, the plaintiff agreed to dismiss the action in consideration of a promissory note of Preston and his wife in the sum of $15,700. The note was given on March 25, 1964, shortly after the Frick decision, and was secured by what turned out to be a third mortgage on the Preston homestead in Wauwatosa, Wisconsin. Upon the default of the note and mortgage by the Prestons, this foreclosure suit was commenced in August, 1964.
